Terms of Service

Important Notice

These Terms of Service ("Terms") govern your use of Glowchat ("Glowchat", "we", "us", "our") and are intended to be conservative and compliant with major payment processors' rules, including Stripe's policies on prohibited and restricted businesses. These Terms are for general informational purposes only and do not constitute legal advice. You are responsible for ensuring that your use of Glowchat complies with all applicable laws and with Stripe's Services Agreement and Restricted Businesses list.

1. Acceptance of Terms

By accessing or using Glowchat, you agree to be bound by these Terms and all policies incorporated by reference (including our Privacy Policy and Community Guidelines). If you do not agree, you may not access or use the Platform.

We may update these Terms at any time. Changes are effective when posted. Your continued use of Glowchat after changes are posted constitutes your acceptance of the updated Terms.

2. Eligibility & Accounts

2.1 Age & Legal Capacity

Fans must be at least 13 years old to create an account and use Glowchat.

Creators must be at least 18 years old to monetize content, receive payouts, or use creator features on Glowchat.

By using Glowchat, you represent and warrant that you meet the applicable age requirements and have the legal capacity to enter into a binding contract.

2.2 Registration

To access certain features (including paid messaging, subscriptions, or creator tools), you must create an account and provide accurate, current, and complete information. You agree to update your information as needed to keep it accurate.

2.3 Account Security

You are responsible for safeguarding your login credentials and for all activity under your account. You must notify us immediately of any unauthorized access or security breach.

2.4 Identity Verification (KYC)

We may require you to verify your identity (e.g., government ID, tax information, address) before unlocking certain features, especially for creators receiving payouts. You agree to cooperate with all reasonable verification and compliance requests (including those required by Stripe and other financial partners).

3. Roles & Use of the Platform

Glowchat is a creator-to-fan messaging platform. Fans purchase GlowCoins (our virtual currency) to send paid messages to verified creators. Creators respond to messages at their own pace and earn revenue through direct messaging interactions.

Glowchat does not provide financial, legal, medical, or other professional services.

  • Fans may purchase GlowCoins to send messages to creators.
  • Creators may monetize their time and expertise through paid messaging within the strict content and conduct rules described in these Terms.

Glowchat is not a bank, money transmitter, or escrow service. We facilitate payments through third-party payment processors (such as Stripe); we do not hold funds as a trustee or fiduciary for users.

3.1 Chat Management & Assisted Messaging

Glowchat employees, contractors, or authorized chat managers may occasionally assist creators with messaging.This assistance may include:

  • Responding to fan messages on behalf of creators with the creator's explicit consent,
  • Managing high message volumes during peak times,
  • Providing customer support or technical assistance through creator accounts,
  • Quality assurance, training, or safety monitoring of conversations.

By using Glowchat, you acknowledge and agree that:

  • Messages from a creator account may be sent by the creator themselves or by authorized personnel acting on their behalf,
  • Glowchat employees may access, review, or respond to messages for operational, safety, or compliance purposes,
  • All messages sent through a creator's account are considered authorized by that creator, regardless of who physically types them.

This practice is common in creator economy platforms and helps creators manage their workload while maintaining quality interactions with fans. All messaging activity remains subject to these Terms and our content policies.

4. Content Guidelines (High-Level)

4.1 User Content

You retain ownership of content you upload or post ("User Content"), but by using Glowchat you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, host, distribute, display, and adapt your User Content solely to operate, improve, market, and secure the Platform.

You are solely responsible for your User Content and for ensuring it complies with these Terms and all applicable laws.

4.2 Absolutely Prohibited Content

Important: No Sexually Explicit Content Allowed

Glowchat is a family-friendly platform. All sexually explicit content is strictly prohibited, regardless of whether it involves adults or minors. This is a zero-tolerance policy enforced to comply with payment processor requirements and applicable laws.

Glowchat strictly prohibits the following categories of content. Posting or attempting to monetize any of the below will result in immediate removal and may lead to permanent account termination and reporting to payment partners and/or law enforcement:

Adult / sexually explicit content (ALL sexually explicit content is prohibited), including:

  • Pornography or explicit sexual acts of any kind
  • Full or partial nudity primarily intended to arouse
  • Sex services, escorting, or any sexual solicitation
  • Explicit fetish content or content that sexualizes individuals
  • Suggestive or sexually provocative content
  • Sexual conversations, "sexting," or erotic roleplay

Content involving minors, including:

  • Any sexualized depiction of minors (real or simulated)
  • Any exploitation, endangerment, or abuse of children

Illegal or highly regulated goods or services, including but not limited to:

  • Drugs (illegal narcotics or non-compliant prescription drugs)
  • Drug paraphernalia
  • Weapons, firearms, ammunition, explosives
  • Counterfeit goods, stolen property, or any contraband

Gambling and betting, including:

  • Online casinos, sports betting, lotteries, raffles and similar schemes

Financial and high-risk services, including:

  • Unlicensed investment services, securities, or FX
  • Crypto schemes that violate applicable laws or payment partner rules
  • Debt collection, "get rich quick" schemes, or deceptive investment programs

Hate, harassment, and violence, including:

  • Hate speech targeting protected classes
  • Incitement to violence, terrorism, or self-harm
  • Content praising or promoting violent extremist organizations

Intellectual property violations, including:

  • Pirated software, films, music, or other copyrighted works
  • Unauthorized sharing of third-party photos, videos, or personal data

Fraud, deceptive practices, or scams, including:

  • Impersonation of other people or brands
  • Phishing, fake offers, or multi-level fraud schemes

This list is illustrative and not exhaustive. If you are unsure whether your content or activity is allowed, you should assume it is not allowed until clarified.

5. Prohibited Conduct

In addition to the content restrictions above, you must not:

  • Use Glowchat for any illegal purpose or in violation of any law or regulation.
  • Circumvent or attempt to circumvent our content filters, age gates, compliance checks, or payment checks.
  • Harass, threaten, or stalk other users, or send unwanted explicit messages.
  • Use automated tools (bots, scrapers) to access or collect data from Glowchat except as explicitly allowed.
  • Interfere with the security, integrity, or performance of the Platform.
  • Misrepresent yourself, your identity, or your affiliation (including pretending to be a Glowchat or Stripe employee).

6. Payments, Payouts & Stripe

6.1 Payment Processing

Payments on Glowchat (including purchases, tips, and subscriptions) are processed by third-party providers such as Stripe. By making or receiving payments, you also agree to those providers' terms and conditions, including Stripe's Services Agreement and Restricted Businesses policies.

Glowchat does not store full payment card details and relies on its payment partners for secure processing.

6.2 Creator Earnings

Creators earn money through paid messaging on Glowchat:

  • Fans pay GlowCoins to send messages
  • Creators set their own message prices
  • Creators keep 55% of message revenue

Glowchat charges a 45% platform fee that covers payment processing, infrastructure, safety moderation, and customer support. This fee is disclosed in your creator dashboard.

Creators are solely responsible for taxes, reporting income, and complying with their local tax laws.

6.3 Holds, Chargebacks & Reversals

To comply with Stripe and card network rules, Glowchat and/or Stripe may:

  • Place a hold on payouts if suspicious or high-risk activity is detected,
  • Reverse or refund transactions in cases of chargebacks or disputes,
  • Withhold payouts if we reasonably believe a user or creator is in violation of these Terms or payment partner rules.

6.4 Refunds

Digital content is generally non-refundable, except where required by law or when a transaction is clearly made in error or due to technical issues. We reserve the right to issue or deny refunds at our sole discretion, taking into account card network and Stripe requirements.

7. Compliance, Sanctions & AML

You agree that you will not use Glowchat if:

  • You are located in, or ordinarily resident in, a country or territory subject to comprehensive sanctions that would prohibit the use of Stripe or Glowchat; or
  • You are included on any government sanctions or restricted party list applicable to our operations.

We may perform checks (directly or via Stripe or other partners) to comply with anti-money laundering (AML), counter-terrorist financing (CTF), and sanctions regulations. We may suspend or terminate your account, or block transactions, if we reasonably believe such action is necessary to comply with applicable law or payment partner requirements.

8. Content Moderation & Enforcement

Glowchat uses a combination of automated tools and human review to moderate content and activity.

We reserve the right, at our sole discretion, to:

  • Remove or restrict access to any content that violates these Terms or that we reasonably believe may harm users, Glowchat, or our partners (including Stripe).
  • Suspend or terminate accounts that violate our content rules or payment partner policies.
  • Restrict access to monetization or certain features while we investigate reported or suspicious activity.
  • Report illegal content or conduct to law enforcement or other authorities where appropriate.

We are not obligated to monitor all content, but we may do so to protect the Platform and its users.

9. Privacy & Data Protection

Your use of Glowchat is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data.

  • We implement commercially reasonable security measures, but no system can be 100% secure.
  • By using the Platform, you acknowledge that you transmit data at your own risk and agree that we are not liable for unauthorized access beyond what is required by law.

10. Intellectual Property

10.1 Platform IP

All content on Glowchat that we create or provide (excluding User Content) — including design elements, features, logos, trademarks, and software — is owned by Glowchat or its licensors and is protected by copyright, trademark, and other laws.

You may not copy, modify, distribute, or create derivative works from our IP except as expressly permitted by us in writing.

10.2 Copyright Complaints

If you believe your copyright has been infringed on Glowchat, you may send us a notice with:

  • Your contact information,
  • Identification of the copyrighted work,
  • Identification of the allegedly infringing content,
  • A statement of good-faith belief and accuracy, and
  • Your signature (physical or electronic).

We may remove or disable access to allegedly infringing content and may terminate repeat infringers.

11. Disclaimers

Glowchat is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to:

  • Fitness for a particular purpose
  • Non-infringement
  • Availability, security, or error-free operation

We do not guarantee:

  • Any particular earnings for creators through messaging,
  • That payments will always process without delay or interruption, or
  • That Stripe or other partners will approve or continue processing payments for your account.

12. Limitation of Liability

To the maximum extent permitted by law, Glowchat and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to your use of the Platform.

Our total liability for any claim arising out of or relating to these Terms or the Platform shall not exceed the greater of:

  • The amounts paid by you to Glowchat in the 3 months immediately prior to the claim, or
  • USD $100.

Some jurisdictions do not allow certain limitations, so these may not apply to you in full.

13. Indemnification

You agree to indemnify, defend, and hold harmless Glowchat, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Platform,
  • Your User Content,
  • Your violation of these Terms, or
  • Your violation of any law or third-party rights.

15. Termination

We may suspend or terminate your account at any time, with or without notice, if we reasonably believe you have:

  • Violated these Terms,
  • Violated our content or payment policies, or
  • Created risk or possible legal exposure for Glowchat or our partners (including Stripe).

Upon termination:

  • Your right to use Glowchat immediately ceases.
  • We may retain certain information as required by law, card network rules, or our legitimate business interests.
